The following describes the terms on which PeopleStox offers you access to our services.
Introduction
Welcome to PeopleStox. By using PeopleStox (including PeopleStox.com and its related sites, services and tools), you agree to the following terms with PeopleStox and the general principles for the websites of our subsidiaries and international affiliates. PeopleStox reserve to modify these terms and conditions at anytime. Users will be notified of the updates. If you don't agree with the new updates, you will have the option to cancel your account by sending us an email to admin@peoplestox.com. If you agree with the new terms and conditions, you don't need to do anything.
This Agreement is effective on September 1, 2010, for current users, and upon acceptance for new users.
Scope
Before you may become a member of PeopleStox, you must read and accept all of the terms in, and linked to, this User Agreement. We strongly recommend that, as you read this User Agreement, you also access and read the linked information. By accepting this User Agreement, you agree that this User Agreement will apply whenever you use PeopleStox sites or services, or when you use the tools we make available to interact with PeopleStox sites and services
Using PeopleStox
While using PeopleStox sites, services and tools, you will not:
1. violate any law, statute, ordinance or regulation
2. relate to sales of (a) narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety, (b) drug paraphernalia, (c) items that encourage, promote, facilitate or instruct others to engage in illegal activity, (d) items that promote hate, violence, racial intolerance, or the financial exploitation of a crime, (e) items that are considered obscene, (f) items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction, (g) certain sexually oriented materials or services, or (h) ammunition, firearms, or certain firearm parts or accessories, or (i) ,certain weapons or knives regulated under applicable law
3. relate to transactions that (a) show the personal information of third parties in violation of applicable law, (b) support pyramid or ponzi schemes, matrix programs, other “get rich quick” schemes or certain multi-level marketing programs, (c) are associated with purchases of real property, annuities or lottery contracts, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card, (d) are for the sale of certain items before the seller has control or possession of the item, (e) are by payment processors to collect payments on behalf of merchants, (f), are associated with the following Money Service Business activities: the sale of traveler’s checks or money orders, currency exchanges or check cashing,or (g) provide certain credit repair or debt settlement services
4. involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent
5. violate applicable laws or industry regulations regarding the sale of (a) tobacco products, or (b) prescription drugs and devices
6. involve gambling, gaming and/or any other activity with an entry fee and a prize, including, but not limited to casino games, sports betting, horse or greyhound racing, lottery tickets, other ventures that facilitate gambling, games of skill (whether or not it is legally defined as a lottery) and sweepstakes unless the operator has obtained prior approval from PeopleStox and the operator and customers are located exclusively in jurisdictions where such activities are permitted by law.
7. post content or experiences that can be harmful to the PeopleStox users community
8. use our sites, services, or tools if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from using our sites, services, or tools
9. fail to deliver payment for items purchased by you, unless the seller has materially changed the item's description after you submitted your payment, a clear typographical error is made, or you cannot authenticate the seller's identity;
10. fail to deliver items purchased from you, unless the buyer fails to meet the posted terms, or you cannot authenticate the buyer's identity;
11. manipulate the price of any item or interfere with other users' listings;
12. circumvent or manipulate our fee structure, the billing process, or fees owed to PeopleStox;
13. post false, inaccurate, misleading, defamatory, or libelous content (including personal information);
14. take any action that may undermine the Feedback or ratings systems (such as displaying, importing or exporting Feedback information off of the sites or using it for purposes unrelated to PeopleStox);
15. transfer your PeopleStox account (including Feedback) and user ID to another party without our consent;
16. distribute or post spam, unsolicited, or bulk electronic communications, chain letters,
17. distribute viruses or any other technologies that may harm PeopleStox, or the interests or property of PeopleStox users;
18. copy, modify, or distribute rights or content from the PeopleStox sites, service, or tools or PeopleStox's copyrights and trademarks; or harvest or otherwise collect information about users, including email addresses, without their consent.
Your Responsibilities
You are solely responsible for your interactions with other users of our Service, including the content of the materials you post on the Service and in your messages to other users of the Service. You agree to take reasonable precautions in all interactions with other users of the Service, particularly if you decide to meet offline or in person. In addition, you agree to review the following recommendations prior to using the Service. You should not provide your financial information (for example, your credit card or bank account information) to other users of our Site.
If you are planning on redeeming an experience someone in person, remember the following:
• Never give out your home or office phone number as an initial means of contact. Use the service features offered on our system or an anonymous e-mail address or mobile phone number.
• Try and tell at least two people where you're going to be, the name of the person you're meeting, what they look like and when you expect to be home. You can also let these people know the purpose of the meeting.
• Always meet in a visible, neutral location. Provide your own transportation to and from and never make arrangements to meet or be picked up at your home or office.
• Always meet in a public place like a restaurant or coffee shop.
• Go at your own pace.
• Always be mindful of the personal details you're providing and do not reveal information that may make it easy to locate you in the event you do not wish to see the person again.
• Use your common sense and good judgment. If you get a bad feeling about the Experience, it may be better to simply cancel.
Abusing PeopleStox
PeopleStox and the Community will work together to keep our sites and services working properly and the Community safe. Please report problems, offensive content, and policy violations to us.
The PeopleStox Investigation Team (PIT) program works to ensure that listed items do not infringe upon the copyright, trademark, or other intellectual property rights of third parties. If you believe that your intellectual property rights have been violated, please notify our PIT team through our support@peoplestox.com email and we will investigate.
Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our sites and their content, services, and tools, delay or remove hosted content, and take technical and legal steps to keep users off the sites if we think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue PeopleStox sites, services, or tools.
Fraudulent activities will not be tolerated in PeopleStox. Any buyer or seller that is found to be involved in fraudulent activities will be removed from PeopleStox, and any funds pending on his/her account will not be reimbursed. PeopleStox reserves the right to monitor any transaction, locations and communication between users to determine whether any fraudulent transaction is taking place. PeopleStox reserves the right to collect any amount already paid, that is later found to be related to any fraudulent transaction.
Users who communicate between themselves using a different method other than the communication system provided by PeopleStox, or who provide personal email addresses to other users, will be suspended. Experiences that are delivered to the users using external methods, other than those provided by PeopleStox, will not be paid, and the amounts will be refunded to the buyers. PeopleStox will not be liable for experiences that are provided outside our marketplace.
PeopleStox reserves the right to monitor every account to enforce compliance with our Terms and Conditions.
Buyer Protection
Buyers and sellers share the responsibility for making sure products and experiences facilitated by PeopleStox are exciting, rewarding, and hassle-free. We strongly encourage buyers to work with sellers before opening a claim relating to a purchase. Buyers and sellers agree to follow the requirements of the PeopleStox Buyer Protection Policy with respect to claims. PeopleStox Buyer Protection covers only claims filed in accordance with the PeopleStox Buyer Protection Policy, not claims filed with PayPal. We may suspend the PeopleStox Buyer Protection Policy without notice if we suspect abuse or interference with the proper working of the program.
We require PeopleStox sellers to comply with our resolution process. Sellers permit us to make a final decision, in our sole discretion, on any claim that a buyer files with PeopleStox under the PeopleStox Buyer Protection Policy. If we resolve a dispute in the buyer's favor, we will refund the buyer for the cost of the item and the original shipping, and we will require the seller to reimburse us for the refund. Without limiting the foregoing, sellers may not have to pay a reimbursement for an PeopleStox claim if they provide the documentation (for example, delivery confirmation or proof that the item was as described) indicated in the PeopleStox Buyer Protection Policy.
- Buyers and Sellers must have a reimbursement method on file with PeopleStox (Paypal account).
- For transactions paid with PayPal, sellers agree to allow us to remove funds from their PayPal accounts to reimburse buyers. Sellers may change this reimbursement method by contacting PeopleStox.
- When there are insufficient funds in PayPal accounts, transactions are not paid with PayPal, or when PayPal is not the reimbursement method of a seller, we will require another reimbursement method.
For future claims where the seller is found at fault, we will notify the seller and continue to charge the sellers preferred method for any reimbursements made under the PeopleStox Buyer Protection Policy. Changing a reimbursement method will not affect PeopleStox's use of a payment method on file for other purposes (such as payment of your PeopleStox fees). If sellers do not provide PeopleStox with a valid reimbursement method, we may collect amounts owed using other collection mechanisms, including retaining collection agencies. We may also suspend or restrict sellers from trading on our sites until payment is made.
Fees and Services
Joining PeopleStox is free. We do charge the seller a 15% commission fees for transactions that are redeemed. When you list a product or experience, you agree to this charge, which we may change from time to time. Changes to that fee are effective after we provide you with at least 14 days' notice by posting the changes on the PeopleStox site. We may choose to temporarily change the fees for our services for promotional events (for example, free listing days) or new services, and such changes are effective when we post the temporary promotional event or new service on the sites.
Unless otherwise stated, all fees are quoted in U.S. Dollars. You are responsible for paying all fees and applicable taxes associated with our sites and services in a timely manner with a valid payment method. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms. (This includes charging other payment methods on file with us, retaining collection agencies and legal counsel, and for accounts over 180 days past due, deducting the amount owed from your PayPal account balance.)

If your country doesn't support receiving payments we apologize in advance, but we won't be able to send you the money to your bank accounts based on your paypal ID. You will only be able to buy Xperiences. Please check back as paypal is often updating their coverage.
Content
When you post content in our page, we don't claim any rights to it, nor we are responsible for it. You agree that you have the rights to distribute it.
For the convenience of sellers, we may offer catalogs of stock images, descriptions, and product specifications that are provided by third parties (including PeopleStox users). You may use catalog content solely in connection with your PeopleStox listings during the time your listings are on PeopleStox's sites.
While we try to offer reliable data, we cannot promise that the catalogs will always be accurate and up-to-date, and you agree not to hold our catalog content providers or us responsible for inaccuracies in catalogs. If you choose to include catalog content in your listings, you continue to be fully responsible for your listings and for ensuring that your listings are accurate, do not include misleading information, and comply with this User Agreement and all PeopleStox policies. The catalogs may include copyrighted, trademarked, or other proprietary materials. You agree not to remove any copyright, proprietary, or identification markings included with the catalogs or create any derivative works based on catalog content (other than by including them in your listings).
Limitation of Liability
You will not hold PeopleStox responsible for other users' content, actions, or inactions, items they list or their destruction of allegedly fake products or experiences, or actions between users that could result in harm of the user community. Our sites are venues to allow anyone to offer, sell, and buy just about talent oriented products and experiences, at anytime, from anywhere, in a variety of pricing formats and locations. We facilitate the actual transaction between buyers and sellers. While we may help facilitate the resolution of disputes through various programs, we have no control over and do not guarantee the quality, safety, or legality of items advertised, the truth or accuracy of users’ content or listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction or return an item.
We will not be responsible for any damage or harm resulting from your use of the service or interactions with other users of our Service. While we do make certain efforts to screen users, you understand that we do not in any way inquire into the backgrounds of the users of the Service or attempt to verify their statements. We make no representations or warranties as to the conduct of our users or their compatibility with any current or future users. We reserve the right, but have no obligation, to monitor all interactions between you and other users of our Service and to take any action in good faith to restrict access to or the availability of any material that we or another user of our Service may consider to be obscene, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable. Email messages sent between you and other users of the Service that are not readily accessible to the general public may be reviewed by us for compliance with these Terms, but will be treated by us as private to the extent required by applicable law. In no event shall we be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Service, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other users of the Service or persons you meet through the Service. We are not responsible for, and cannot control, the use by others of any information which you provide to them and you should use caution in selecting the personal information you provide to others through the Service. We cannot assume any responsibility for the content of messages sent by other users of the Service, and you release us from any and all liability in connection with the Service and the contents of any communications you may receive from other users.
We do not transfer legal ownership of items from the seller to the buyer. Further, we cannot guarantee continuous or secure access to our sites, services, or tools, and operation of our sites, services, or tools may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill or reputation, or any special, indirect or consequential damages arising, directly or indirectly, out of your use of or your inability to use our sites, services, and tools.
Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
Regardless of the previous paragraphs, if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the total fees (under PeopleStox Fees and Services) you paid to us in the 12 months prior to the action giving rise to the liability, and (b) $100.
Release
If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
Access and Interference
The sites contain robot exclusion headers. Much of the information on the sites is updated on a real-time basis and is proprietary or is licensed to PeopleStox by our users or third parties. You agree that you will not use any robot, spider, scraper, or other automated means to access the sites for any purpose without our express handwritten permission.
Additionally, you agree that you will not:
- take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure;
- copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for your information) from the sites without the prior express written permission of PeopleStox and the appropriate third party, as applicable;
- interfere or attempt to interfere with the proper working of the sites, services, or tools, or any activities conducted on or with the sites, services, or tools; or
- bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the sites.
Privacy
We do not sell or rent your personal information to third parties for their marketing purposes. We view protection of users' privacy as a very important community principle. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by us.
Communication
Peoplestox will send you from time to time emails with important communication or newsletters relevant to our page. This communication may contain news, special promotions, articles of interest, links to specific pages, etc. If you wish to unsubscribe from these communications, you will have the option to do so from the emails sent.
